INTRODUCTION

At Eagles Plumbing Plus we recognize the importance of your order. We realise that for most clients choosing bathroom, kitchen and laundry products is not easy.

We also recognise that customers from time to time will change their minds or be forced to select alternative products because the builder, renovator or plumber cannot install their original choice for a variety of reasons. However, our customers should fully understand that while we will do everything possible to accommodate changes, there can be certain costs we simply cannot incur.

Therefore, Eagles Plumbing Plus have developed a small number of terms & conditions to ensure that customer orders are handles in a smooth and efficient manner and to prevent any ambiguity.

Customers are advised to read these conditions carefully and fully understand their implications. Should you have any questions our customer service team will only be too happy to explain the contents.

By accessing, browsing and/or using this web site you acknowledge that you have read, understood and agree to be bound by these terms and conditions as set out below.

TRADING TERMS AND CONDITIONS OF SALE

These conditions relating to online purchasing will prevail over any conditions in the Customers order whether expressed or implied unless otherwise agreed by the Supplier in writing. Alterations to these terms and conditions may be made by Eagles Plumbing Plus at any time, without notice and will be updated on our website .

These terms and website are governed by and in accordance with the laws and/or regulations of the state of New South Wales, Australia.

1) PAYMENT

When placing an order online, full payment is required at order confirmation stage via E Way Online Payment Gateway. Accepted mode of payment to be made by either Visa, Mastercard credit cards or Visa Debit card.

2) PRICING

The prices of goods shall be as specified by Eagles Plumbing Plus at the time of purchase. Prices and list of goods may be varied by the Eagles Plumbing Plus at any time without notice and will only apply to future orders.

3) GST

In this clause the expressions “GST”, “input tax credit”, “tax invoice”, “recipient” and “taxable supply” have the meanings given to the expressions in the New Tax Systems (Goods and Services Tax) Act 1999. Conditions are inclusive of GST.

If GST is applicable on any supply made under or in accordance with these terms and conditions, the recipient of the taxable supply must pay to the supplier an amount equal to the GST payable on or for the taxable supply subject to the provision of a tax invoice.

4) ORDER SELECTION

Customers are advised to exercise care when selecting items which are specially made to their specifications. Once ordered these items are non-returnable and the customer will be liable for the full cost of the item.

5) RETURNS

  • Any goods that have been installed are not returnable or able to be exchanged.

  • Please choose carefully as full refunds are not provided where you have simply changed your mind, made a wrong selection or simply found the goods cheaper elsewhere. We recommend you carefully preview any products before adding them to your order.

  • Items which are ordered and subsequently returned for exchange are subject to a re-stocking fee on the return of the goods (generally but not limited to 20% of the value of the goods). It is the customers responsibility to cover this surcharge

  • Customers must also pay any return freight or Eagles Plumbing pickup charges in the event of an exchange or product unsuitability.

  • All goods are subject to manufacturer’s guarantee and trading terms.

6) DELIVERY / PICKUP TERMS

* Customers who select store pickup will be advised when their goods are ready for collection. If an Eagles Plumbing delivery is required a customer service team member will contact you to arrange a date and approx. time, Eagles Plumbing will also need to be advised of any special delivery instructions, i.e Limited access etc *Eagles Plumbing has no control over date or time of deliveries if goods are being sent by third party freight/courier ( ie outside our branch delivery areas ) * All store pick ups are subject to a pre-arranged time between the hours of 7.30 am and 5.00 pm Monday to Friday.

  • If freight is via a third party provider, Eagles Plumbing Plus recommends the buyer takes up the insurance option, so that if goods are damaged on arrival, we can assist you in claiming the insurance.

  • Ensure that any goods are inspected prior to installation, as Eagles Plumbing Plus will not recognise any claims if the product has been installed (unless for faults covered by standard manufacturer warranty)

  • No claim for damage will be recognised if the goods have been signed for after a delivery or store pick up, please inspect all goods before signing for them

7) CUSTOM SPA’S

When ordering spa’s you will be asked to choose a pump position and confirm this via e-mail, before the order is placed with the manufacturer.

8) WARRANTIES AND LIABILITIES

All goods are sold subject only to the manufacturer’s guarantees and warranties, if any, and all other implied conditions and warranties in relation to the supply of goods which may by law be excluded are excluded.

The Supplier’s liabilities for a breach of a condition or warranty implied by Division 2 of Party 5 of the Trade Practices Act 1974 (other than Section 69) is limited to: In the case of goods any one or more of the following as nominated by the Supplier. a. the replacement of the goods or the supply of equivalent of goods. b. the payment of the cost of replacing the goods or acquiring equivalent goods. c. the payment of the cost of having the goods repaired; or In the case of services either one of the following remedies as nominated by the creditor a. the supplying of the services again, or b. the payment of the cost of having the services supplied again

The Supplier will not be liable for any consequential loss claimed by the Customer as a result of the supply of goods as a result of any breach of this agreement by the Supplier.

The Customer agrees that the Supplier is not liable for any advice or information provided by the Agents or Employees of the Supplier for any goods for a particular purpose and all advice is at the Customer’s risk.

9) DESCRIPTION OF GOODS

The descriptions, illustrations and performances contained in catalogues, price lists and other advertisements are approximate only and by way of general description. Goods are supplied in accordance with normal industry standards of manufacture and the Supplier will not be liable to the Customer in respect of goods which comply with these standards. It is the purchaser’s responsibility to check all products for colour match, type, condition and quantities upon receipt. Colour matching to a previous delivery, order or sample cannot be guaranteed.

10) TITLE

Until full payment for the goods has been made, the Customer acknowledges and agrees that:- The ownership of the goods shall remain with the Supplier. It shall store the goods in such a manner so the goods are clearly identifiable as the property of the Supplier. It shall comply with all reasonable demands of the Supplier concerning the manner and method by which the goods are stored. The Supplier is to enter the customer’s premises (or the premises of any associated company or agent where the goods are located) without liability for trespass or any resulting damage to retake possession of the goods and The Supplier may keep or resell any goods repossessed pursuant to above. If the goods are resold by the customer, the customer will hold such part of the proceeds of the sale as represents the purchase price of the goods sold in a separate identifiable account as the beneficial property of the Supplier and will pay such amount to the Supplier upon request. Notwithstanding the provision of this clause, the Supplier will be entitled to maintain an action against the purchaser for the full purchase price and the risk of the goods will pass to the Customer upon delivery.

11) ACCEPTANCE

Eagles Plumbing Plus’ acceptance of a clients order is taken as acceptance by the client of these terms & conditions.
